Scale Up Visa

A scale Up Visa may be available to you if you are a talented individual who has been recruited by an existing UK Scale-up Sponsor. You must have the demonstrable skills needed to enable the Scale-up business to continue growing. You will need a highly-skilled job offer from a qualifying Scale-up business at the required salary level. A Scale-up Worker visa allows you to come to the UK to do an eligible job for a fast-growing UK business (sometimes called a ‘scale-up business’). Your UK employer must meet specific eligibility criteria to sponsor scale-up workers. With a Scale-up Worker visa, you can work for a fast-growing UK business (also known as a ‘scale-up business’).

Your UK employer must meet specific eligibility criteria to sponsor scale-up workers. There is a settlement route in the UK called the Scale-Up route. It is permissible for applicants to be accompanied by their partners or dependent children. In the Scale-up Visa route, both Sponsored and Unsponsored Applications are available.  A sponsored application is required if this is your first time applying through the Scale-Up route. An Unsponsored Application is only available to Scale-up Workers who have previously been granted permission.

What are the requirements for a Sponsored Scale-up Visa?

A Sponsored Application for a Scale-Up Visa requires that you demonstrate the following to UK Visas and Immigration:

  • You are at least 18 years of age;
  • For the job you are planning to perform, you have a valid Certificate of Sponsorship from a qualified Scale-up sponsor;
  • You intend to perform a legitimate job;
  • Your job is at a skill level appropriate for the position (graduate level or higher);
  • It is expected that your salary will be equivalent to or exceeding both £34,600 per year and the ‘going rate’ for the position;
  • As a minimum, you possess the ability to communicate effectively in English to the level of CEFR Level B1 (equivalent to an IELTS score of 4.0);
  • Your financial situation allows you to support yourself without relying on public assistance;
  • If required, you have provided a valid TB certificate.

What are the requirements for an unsponsored scale-up visa?

An unsponsored application for a Scale-Up Visa requires that you demonstrate the following to UK Visas and Immigration:

  • You are at least 18 years old;
  • The Scale-up Worker status has already been granted to you;
  • Your PAYE earnings in the UK were at least £34,600 per year (or £33,000 per year if you were granted permission on the route on or before 11 April 2023 on the basis of a Certificate of Sponsorship) during at least 50% of your most recent permission grant as a Scale-up Worker;
  • English language proficiency of at least CEFR Level B1 (equivalent to IELTS 4.0);
  • There is enough money for you to support yourself without relying on public assistance;
  • A valid TB certificate has been provided, if necessary.

What is the Scale-up Visa Certificate of Sponsorship (CoS) Requirement for a Sponsored Application?

If you are applying for a Scale-up Visa through a Sponsored Application, you will need a valid Certificate of Sponsorship.  Scale-up Workers must be sponsored by employers who have been approved by the Home Office to sponsor them.

In order to become a Scale-up Sponsor, your employer can either follow the standard pathway or follow the endorsing body path.

What is the Standard Pathway ?

A standard pathway automatically assesses the employment and turnover growth of your employer based on the information they have provided to HMRC.

In terms of turnover or staffing, your employer must have grown by at least 20% annually for the last three years. At the beginning of this 3-year period, they must have had at least 10 employees.

What is the Endorsing Body Pathway?

Those who cannot qualify under the standard pathway due to insufficient HMRC history can demonstrate a clear potential/ability to qualify under the endorsing body pathway.

A scale-up sponsor licence can only be applied for by an employer who has been approved by an endorsing body.

The endorsing body will need to verify that your employer meets various requirements.

What are the General CoS Requirements?

Your sponsor must be listed as A-rated on the Home Office’s register of licensed sponsors, regardless of how they registered.

Scale-up Sponsors with A-rated licences may be able to sponsor you for 6 months in an occupation at least RQF level 6, with a salary that equals or exceeds £34,600 per year.

During the 3-month period preceding your Scale-up Visa Sponsorship Application, your Certificate of Sponsorship must have been issued.

Your Certificate of Sponsorship must include certain mandatory information, including:

  • Name, job title, and salary information;
  • An acknowledgement of your Sponsor’s expectation that you will work for them for a minimum of six months;
  • The start date should be no more than three months after your Scale-up Worker Visa application;
  • Proof that the Certificate of Sponsorship has not been used in a previous application, whether granted or refused, and has not been withdrawn by the sponsor or revoked by the Home Office.

What is the Genuine Job Requirement?

You must show that you are being sponsored for a legitimate job to be granted a Scale-up Visa.

You will be denied a Scale-up Visa if you have reasonable grounds to believe that the job you are being sponsored for does not exist, is a sham, or was created primarily so that you may apply for the visa.

You will also need to satisfy the Home Office that you haven’t entered into a contract that will require you to fill a temporary or permanent position for a third party that is not your sponsor, or that you haven’t taken on contract work that involves providing ongoing routine service to a third party that is not your sponsor or undertaking an ongoing routine role.

What is the Job Skill Level Requirement for a Sponsored Application?

For a Sponsored Application to be successful, the job you are being sponsored for must be an eligible job at or above a minimum skill level (at least RQF level 6).

A list of jobs eligible for the Scale-up route has been published by the Home Office. The list includes occupation codes, job types, and related job titles.

As long as the job for which you are being sponsored is listed, you are most likely to meet the job skill level requirements.

However, your sponsor must select an occupation code that is appropriate for your position.  Your Scale-up Visa application will be rejected by the Home Office if the Home Office believes that your sponsor has chosen the incorrect occupation code.

A number of factors will be considered by the Home Office when determining whether your sponsor has chosen the appropriate occupation code for your position, including whether there is a genuine need for the position as described, whether you possess the appropriate skills, qualifications, and experience to accomplish the job, as well as whether the sponsor has been compliant with the immigration law in the past.

What is the Scale-up Visa Salary Requirement for a Sponsored Application?

In order to qualify for a Scale-up Visa via a Sponsored Application, the salary for the job you are being sponsored for must be equivalent to or greater than both £34,600 per year and the ‘going rate’ for the job (outlined in the relevant occupation code above).

What is the General salary requirement?

Salary assessments are based on guaranteed basic gross wages (up to 48 hours per week) without regard to any other pay or benefits.

It may be considered for the salary threshold of £34,600 if the applicant is sponsored to work a pattern in which the regular hours are not the same each week, resulting in uneven pay. Work in excess of 48 hours can be considered, provided the average over a regular cycle (which can be less than 17 weeks in length) is not more than 48 hours a week on average. When considering whether the salary thresholds are met, unpaid rest weeks will be considered as part of the average.

What is the Going rate requirement?

In order to determine the going rate for occupation codes eligible for Scale-up Visas, the Home Office has published a list.  Based on a 37.5-hour work week, the going rate must be prorated.

What are the UK Earnings as a Scale-up Worker Requirement for an Unsponsored Application?

Applicants can obtain Scale-up Visas through Unsponsored Applications if they have earned in the UK a monthly salary equivalent to at least £34,600 annually (or £33,000 annually if your most recent permission on this route was granted on the basis of a Certificate of Sponsorship issued before 11 April 2023) during at least 50% of the time spent working as a Scale-up Worker while on leave.

Your guaranteed basic gross salary, recorded through UK-based PAYE, will be considered by the Home Office.  Other sources of income (including earnings from self-employment and earnings from outside the UK) will not be considered.

If you were absent from work in a job with PAYE earnings of at least £34,600 per year (or £33,000 per year if your most recent permission on the route was granted on the basis of a Certificate of Sponsorship assigned on or before 11 April 2023) due to statutory maternity leave, paternity leave, parental leave, shared parental leave, statutory adoption leave or sick leave, these periods of absence will be treated as periods during which you were paid the equivalent of at least £34,600 per year (or £33,000 per year as appropriate).

What is the Genuine Earnings Requirement?

You will need to satisfy the Home Office that your PAYE earnings are genuine prior to being granted a Scale-up Visa.

It will be refused to process your Scale-up Worker application if there are reasonable grounds to believe that your PAYE earnings are fabricated or inflated or do not relate to genuine employment.

What is the English Language Requirement for Scaling-up Applications?

If you wish to apply for a Scale-Up Visa (either under Sponsorship or without Sponsorship), you must demonstrate a level of proficiency in English language ability (reading, writing, speaking and listening) of at least B1 (intermediate) in all four components.

The English language requirement will be satisfied by talented individuals with high-skilled job offers from qualifying UK Scale-up businesses applying for entry clearance or leave to remain as a Scale-up migrant if:

  • You are a national of a country where English is the predominant language;
  • Successfully completed a Secure English Language Test;
  • A degree in English has been awarded to you;
  • Attained GCSE/A Level or Scottish Highers in English while attending school in the United Kingdom;
  • An applicant for entry clearance or permission to remain has already demonstrated that they met the level B1 requirement under a previous successful application for entry clearance or permission to remain.

What are the Scale-up Visa Financial Requirements for all Scale-up Applications?

In order to qualify for a Scale-up Visa (whether you apply sponsored or unsponsored), you must have available cash funds of at least £1,270.

Your Scale-up Visa application must be submitted within 31 days of holding the money for at least 28 consecutive days.

If your sponsor is willing to cover your maintenance costs up to the end of the first month of your employment, to the amount of at least £1,270, you will be exempt from the financial requirement.  It is important that your sponsor confirms this on your Certificate of Sponsorship.

The financial requirement will not be required if you have been in the UK with permission for 12 months or more at the time of application.

What is the Immigration Skills Charge Requirement?

Immigration Skills Charges are not applicable to UK Scale-up Sponsors.

Can you Switch into the Scale-up Worker Route?

Unless you have been granted permission to remain in another immigration category or were previously granted permission as a visitor, short-term student, parent of a child student, seasonal worker, domestic worker in a private household or outside the Immigration Rules, you may extend your stay by switching to the Scale-up route.

How long does a Scale-up Visa last?

If you are granted a Scale-up Visa through the Sponsored Application route, you will have the opportunity to remain in the country for a period of two years.  It will be possible for you to apply unsponsored at the end of the two-year period of permission.

You will be granted entry clearance or permission to stay for a period of three years if you are granted a Scale-Up Visa through the Unsponsored Application route.

What are the Stay Conditions on the Scale-up Visa Route?

You must be employed in the job for which you are being sponsored for at least six months before you are approved for a Scale-up Visa under the Sponsored Application route. The immigration status of your original sponsoring employer will not be tied to your immigration status after this initial six-month period.  As a result, you will be able to work for the same employer without being sponsored or obtain additional or alternative employment (such as self-employment or voluntary work) without having to be sponsored.  As well as being permitted to study, you will also be able to work.  There will be no access to public funds available to you.

Scale-up Workers who are granted leave through the Unsponsored Application route will be able to work in any capacity (including employment, self-employment and voluntary work) without being dependent upon a sponsoring employer. As well as being allowed to study, you will also be able to work.  Public funds will not be available to you.

Does the Scale-up Worker route lead to settlement?

You must satisfy UK Visas and Immigration that the following criteria applies to your application for indefinite leave to remain as a Scale-up Worker:

  • Having lived in the UK continuously for a period of five years with valid leave;
  • During the five-year continuous period, each of the following routes (alone or in combination) has been followed with permission: Scale-up, Skilled Worker, Global Talent, Innovator, T2 Minister of Religion, International Sportsperson, Representative of an Overseas Business, Tier 1 Migrant, other than Tier 1 (Graduate Entrepreneur);
  • As of the date of application, you are employed in the UK with a salary paid through PAYE of at least £34,600;
  • Applicants must have earned a minimum of £34,600 in PAYE income per year in the UK (or £33,000 if you have received permission for this route on the basis of a Certificate of Sponsorship issued on or before 11 April 2023) for at least 24 months within the last 3 years prior to submitting their application;
  • You must meet the Knowledge of Life in the UK requirement if you do not qualify for an exemption.

The Home Office will take into consideration your guaranteed basic gross pay, as recorded by PAYE in the United Kingdom.  We will not take into account other sources of income (such as self-employment earnings and earnings from outside the United Kingdom).

In order to calculate your PAYE earnings in the UK during the last three years, absences from work resulting from statutory maternity leave, paternity leave, parental leave, shared parental leave, statutory adoption leave, or sick leave will be treated as periods in which you were paid at least £34,600 per year (or £33,000 if your most recent permission on the route was granted based on a Certificate of Sponsorship issued prior to 11 April 2023).

What is the Genuine Earnings Requirement?

It is necessary to demonstrate to the Home Office that your PAYE earnings are genuine in order to be granted settlement as a Scale-up Worker.

-up Worker ILR applications will be denied if there is reasonable reason to believe that your PAYE earnings have been fabricated or inflated or are not related to genuine employment.

Can your dependents join you on the Scale-up Visa Route?

A scale-up visa holder may be accompanied or joined by a dependent parent or child over the age of 18 and a dependent child under the age of 18.

What is Free Needs Assessment?

If you have an immigration related problem or question, you can have a free assessment with a member of our assessments team.

The assessor will establish why you are calling and what you are looking for assistance with. The assessor will ask you a series of questions to determine your circumstances in relation to your objectives.

The assessment is 100% private and confidential. As we are a private law firm, we work with our clients to overturn Government decisions daily. We do not share any information with any third party.

Although the assessor will be a trained immigration specialist, they are not solicitors and therefore will not give you detailed legal advice or guidance.

If you want to establish what your options are and the best way forward for you, your assessor will collate the necessary information and then speak with one of the resident senior solicitors at the firm to determine what your options are, if and how we could assist and confirm whether we would be prepared to take your case.
