What is a UK Startup Visa?

Please be informed that upon July 13, 2023, all new applications for the Start-Up visa route will be closed. Any applications sent in before that date must have a stamp of approval from a recognised group given before April 13, 2023. Alternatively, you can apply for the Innovator Founder visa, which is now called the Innovator Visa, if you want to immigrate to the UK to start a firm.

Applying for this visa does not necessitate either a degree or the availability of finances.

With the introduction of the Start-up and Innovator Visa programs, the Tier 1 Entrepreneur Visa is no longer available.

Who is Eligible for Start Up Visa UK?

As a popular visa category, the Start-Up Visa has a high eligibility criterion. This means you should be ready to give a lot of proof to show that you are qualified.

In accordance with UK Visas and Immigration (UKVI), the following groups of people are eligible to submit an application:

  • You must be at least 18 years old.
  • This is your first time starting a business in the UK (People on the old Tier 1 Graduate Entrepreneur path are an exception.)
  • You have been given approval from a suitable UK approving body that has checked that your business idea meets the three requirements of being new, scalable, and likely to succeed.
  • If your visa application is approved, you can show that you plan to work on your business in the UK most of the time.
  • The date of your application was within the last three months, and your endorsement was stamped within that time.
  • You are qualified to carry out commercial operations connected to your proposed company venture.
  • Moreover, it is possible to present proof of proficiency in English (up to B2 level on the CEFR Scale).
  • It is possible to prove that you are financially capable of supporting yourself in the UK on your own.

You may be considered if you are:

  • Operating independently as the company’s single proprietor
  • Collaborating with other entrepreneurs (if all team members are eligible for the necessary visas)

What are Startup Visa Requirements?

There are several requirements for this path, and you need to make sure that you fulfil them before submitting your application.

The endorsement requirement is a key component of this visa, along with the eligibility criteria that have already been mentioned.

This is the current list of supporting bodies. Your business idea must be approved by at least one of these groups before it can be used to help you get a visa.

The Home Office states that companies are free to determine for themselves what they consider to be an authentic, novel business concept that meets current or future consumer demands.

You can attach a letter endorsing your proposal to your visa application once it has been accepted. After six, twelve, and twenty-four months, the company will check in with you to assess how well you’re doing in relation to your business objectives.

Endorsing bodies will evaluate your company proposal based on the following criteria:

  • With the goal of being a contributing organisation integrated into the UK, the firm is innovative, viable, and scalable.
  • It is a brand-new company concept (that might or might not exist or be registered) that the candidate has initiated (or was an “instrumental member” of the founding team for) before the company’s commencement of trade.

The company can operate in any industry; what’s important is that you’re well-versed in the field and have a good grasp of the market so you can grow it.

Which endorsing organisation should I approach for endorsement?

It can be hard to figure out which endorsing group is best. If you hire UK Startup Visa Solicitors, we can help you get in touch with the company that best fits your business idea and situation.

You can’t get help from the Home Office with choosing an endorsing group.

A company can apply to the Home Office to become an endorsing body. They must have a history of helping UK business owners and giving them advice on how to grow their ideas.

Can I get permanent residency with the UK Startup Visa?

The visa does not give you the right to stay in the country indefinitely (ILR). On the other hand, it can be used with the Innovator Visa.

If you apply for and get the Innovator Visa after having the visa for two years, you may be able to apply for ILR at this point if you meet the standards. If you have ILR for a year, you might be able to apply for British citizenship.

However, after having a Start-Up or Innovator Visa, some things must be done in order to get ILR. These include keeping in touch with the group that backed you and showing proof that your business effort is moving forward.

How to Apply For Startup Visa UK?

Here are the steps you need to take to apply for a Start-up visa:

  • Make a plan for your new business.
  • Get approval for your start-up from a suitable approved endorsing body 2 in the UK.
  • Once it is approved, you will need to fill out an online application form on the Home Office website. The form you need to fill out will depend on whether you are outside the UK or in the UK moving from a different visa.
  • It’s important to show proof of who you are after sending in your application form. 
    • One way to do this is to get a biometric residence pass, which means having your fingerprints and picture taken at a visa application centre. You will be told which method of identification to use when you apply. A small fee of £19.20 is charged to read and process your biometric information. Your biometric residence card is proof that you live in the UK.
    • your ID by scanning it with the “UK Immigration: ID Check” app.
  • Pay the £363 application fee if you are not in the UK or the £493 fee if you are. These fees are the same for family members who rely on you. If you are from an EU country, you might not have to pay as much for the application.
  • Also, pay the immigration healthcare fee for as long as you have your visa. At the moment, this costs £1035 per person per year.
  • If you apply outside of the UK, it usually takes three weeks to process, but it takes eight weeks if you apply for this visa in the UK. It could take longer if more proof is needed or if you are asked to come in for an interview.

Rejection of UK Startup Visa

You might be able to ask for an official review of the decision if your application for a Start-up Visa is turned down, but it is usually not possible to get the decision changed.

If your Start-up Visa is turned down, here are the steps you should take (please keep in mind that you should always talk to an experienced lawyer about your specific case):

  • Before you send in your application, make sure you carefully read and follow the guidelines to give yourself the best chance of being accepted.
  • When you get a letter of rejection, figure out what to do next (administrative review).
  • As soon as possible, send in your request for an administrative review. Depending on where you filed, you have either 14 or 28 days to do so.
  • You must pay an entry fee of £80 for an administrative review and send your application online.
  • Hold on until a decision is made.

What are the Refusal Reasons for a UK Startup Visa?

Your visa can be refused due to 

  • Failure to present the necessary proof to meet the visa rules
  • Your application has been turned down because of things like criminal records that make you ineligible, breaking immigration rules, giving false information on the application, etc. 

Startup Visas can be hard to understand, so it’s advisable to work with a specialised immigration adviser to improve your chances of being accepted and lower your chances of being rejected.

Is it possible to extend the UK Start-up Visa?

It is not possible to renew the Start-up Visa because it is only given out once. On the other hand, you might be able to switch to the Innovator Visa instead.

  • You can move to this group if the following conditions are met:
  • Possess the minimum level of English
  • Follow the age requirements.
  • Meet the requirement for cash maintenance
  • Have at least £50,000 to put into the business (unless it’s already up and running).

The Home Office will want to see proof that you had at least £1,270 in your bank account for at least 28 days in a row before you applied for or switched to this visa.
