What is a Tier 1 Exceptional Talent Visa UK?

The Global Talent visa has replaced the Tier 1 Exceptional Talent visa for foreigners with world-class talent and prestige in specified fields.

Non-EEA citizens can get the Tier 1 Exceptional Talent visa and come to the UK to work (either for someone else or for themselves), study, or volunteer, usually for up to 5 years. And you might be able to get UK Indefinite Leave to Remain. You can also bring family members and people who depend on you with you.

To be eligible for this type of visa, applicants must show proof that they are a world leader in their area, and the application process is actually quite complicated.

Science, arts, engineering, humanities, digital technology, and design professionals can get the visa.

Duration of Stay

Up to 5 years and 4 months, renewable and leading to Indefinite Leave to Remain.

When applying for a Marriage Visitor Visa, you do not need to pay the Immigration Health Surcharge. This visa is for a short, single stay and does not grant access to the UK’s public healthcare system.

No mandatory English-language or financial maintenance requirement under this category.

When applying for a Spouse visa, you must pay the Immigration Health Surcharge to cover your healthcare costs while in the UK. Since February 2024, the surcharge has been £1,035 per year, following a 86% increase. For in-country application, it will be for 30 months and out-country application, it will be for 33 months.

Partners and children under 18 can accompany or join the main applicant.

The Marriage Visitor Visa allows for a single stay of up to 6 months. This visa cannot be extended, and you must leave the UK at the end of this period.

Eligible for ILR after 3 to 5 years depending on endorsement type and achievements.

This visa allows you to get married or register a civil partnership, but you cannot work, study, or live in the UK. You must use this visa solely to visit and get married.

Holders can work, study, or be self-employed in their field without sponsorship.

How Can I Apply for a UK Exceptional Talent Visa?

This material predates the Tier 1 Exceptional Talent visa’s closure.

People who are not from the EEA or Switzerland can apply. The process has two steps.

The first thing you need to do is get professional support as a world-renowned leader in your area. Your profession’s official governing body must give its approval.

On the Home Office website, you can apply for support. It costs £456 to do so.

After getting approved, you need to apply for the visa at the Home Office.

In this case, you will need to prove that you are eligible for the route and meet the general requirements for permission to enter or stay in the UK.

The requirements for getting into the exceptional talent way are less strict. For example, you don’t have to show proof of your ability to pay your own expenses or that you speak English.

You have up to three months to apply for a visa before your trip.

Applicants must also pay the Immigration Health Surcharge every year for as long as they have permission to stay.

First step: Apply for endorsement.

Exceptional Talent

This section is reserved for candidates who have proven themselves to be influential leaders in their respective fields. In order to show this, you need to show that you have a history of success.

Exceptional promise

This category is for people who have shown they have the potential to be leaders in the future. Applicants should be early in their careers, but they should have demonstrated the ability to become a leader in their industry and make a big impact. Within your application, you need to show that you have grown.

An online application is required to be approved. A “Designated Competent Body,” which is an organisation working in your area, will look over your application. The Royal Society (for science and medicine), The British Academy (for the humanities), Tech Nation (for digital technology), Arts Council England (for art and design), and The Royal Academy of Engineering are all examples of these kinds of groups.

Your application will be sent to the Royal Institute of British Architects, the British Fashion Council, and the Producers Alliance for Cinema and Television, in that order, if you work in building, fashion, or film and TV.

The group can also support applications for the special talent visa under the government’s new Tech Nation Visa Scheme. This is because the government’s goal is to boost this industry in the UK by attracting skilled workers from around the globe.

Most of the time, it takes eight weeks to hear back. The Home Office will send you an email with a copy of your recommendation letter once you are approved. After that, you can move on to the next step and apply for a visa. If your application is denied, you can request an endorsement review.

It is important to remember that getting a recommendation does not mean you will automatically get a visa. Each person’s application for a visa will be judged on its own grounds (see below).

Getting your Exceptional Talent Visa

The Home Office will now look at the immigration parts of your application. They will check to see if there are any General Grounds for Refusal and, if you are already in the UK, they will see if you can switch to Tier 1 (Exceptional Talent).

Requirements for Exceptional Promise Visa

  • You must provide a copy of the endorsement letter that was emailed to you at stage 1.
  • If you don’t apply within 3 months of getting an endorsement, your visa request will be turned down.
  • It is best to apply at least a month before your present leave to remain ends if you are already in the UK.
  • If you apply from outside the UK and are from a place where you have to take the test, you must show the results of your Tuberculosis test.

Common Reasons for Refusal

If you have been involved in illegal activities, breaking immigration rules, or dishonesty, your application may be turned down. Each person is automatically judged on these grounds before their application is even looked at.

Switching from Tier 2 Intra-company Transfer (ICT)

If a migrant with a Tier 2 ICT visa changes to a Tier 1 (Exceptional Talent) visa, they can skip the 12-month cooling-off time.

People who come to the UK with a Tier 2 ICT visa can usually stay for up to 5 years. After this leave is over, migrants have to wait out the cooling-off time. The cooling-off phase lasts for 12 months, and migrants must leave the UK during that time before they can apply to stay longer.

If you choose to move to the exceptional talent visa, however, you can skip this round. Only people with a lot of skills should apply for this visa. People who already have a Tier 2 ICT visa and work in the technology industry should get this visa. Before migrants can switch to a Tier 1 Visa, they need to be approved by the right organisation. Tech Nation is one of the groups that supports people who are applying for a Tier 1 visa.

How to Extend Your Tier 1 Exceptional Talent Visa?

This step is like the first step in the application process. Meet the following requirements to get approved:

  • The Designated Competent Body that gave its approval to your stage 1 application at first has not told the Home Office that this has been revoked; and
  • You have earned money in the UK through work or self-employment in your field during your most recent leave as a Tier 1 (Exceptional Talent) worker. Your Designated Competent Body endorsed you in this field.
