Overview

What Most Applicants Overlook About the EU Settlement Scheme (EUSS)

The EU Settlement Scheme (EUSS) protects the rights of EU, EEA, and Swiss citizens and their family members to live and work in the UK after Brexit – but thousands of people lose their status each year due to missed deadlines or incorrect documentation. Whether you’re applying for pre-settled or settled status, joining a family member under the Family Permit route, or need to update or correct your digital status, understanding the process early can prevent delays, refusals, or loss of lawful residence.

The EUSS applies to EU, EEA, and Swiss nationals and their eligible family members living in the UK.

You must have started living in the UK before 31 December 2020 to qualify (unless joining a family member).

Pre-settled status is usually granted for five years – you must later upgrade to settled status to remain permanently.

Family members of EU citizens may apply from outside the UK using an EUSS Family Permit.

You can update or correct your status if you changed passport, residence, or personal details.

Proof of residence, identity, and relationship documents are required for most routes.

Pre-settled status is temporary (five years). Once you’ve lived in the UK for five continuous years, you can apply for full settled status.

Yes, but only if you have a reasonable excuse such as illness, family issues, or technical barriers. Legal help can strengthen your case.

You should still keep your online status updated (e.g. if you change your passport or details). You don’t need to reapply unless advised.

Yes - they can apply under the EUSS Family Permit route to join you in the UK, either from abroad or within the country.

Yes - pre-settled status lapses after two years’ absence, and settled status can lapse after five years abroad.

Our solicitors assist with new applications, family permits, late submissions, and digital status corrections to protect your rights and avoid refusal.

You must apply to upgrade to full settled status before your pre-settled period ends. If you don’t, your right to work, rent, or access healthcare in the UK may be affected. Our team can help you renew in time and avoid losing your legal status.

If your EUSS application has been refused, you may be able to request an administrative review or submit a fresh application with stronger evidence. We assess your case, identify the refusal reasons, and guide you through the correct appeal or reapplication process.

Keep Your EUSS Status Safe and Certain

Your right to live and work in the UK depends on your EU Settlement Scheme status. Our solicitors make sure your application, renewal, or family permit is handled correctly – protecting you from refusal, expiry, or loss of status.
