Spouse Visa Extension UK – Key Questions Answered
What is a spouse visa extension?
A spouse visa extension is an application to continue living in the UK with your partner. A successful application usually grants up to another 30 months, depending on your route and circumstances.
How much does a spouse visa extension cost?
For one adult applying for a standard 30-month extension, the application fee and health surcharge currently total £3,994.50. Legal fees, tests and optional services are separate.
What are the main requirements?
You normally need an ongoing qualifying relationship, suitable accommodation and evidence that you meet the financial and English requirements for your route, alongside immigration and suitability checks.
Which financial requirement applies?
The usual threshold is £29,000 a year. Qualifying transitional cases start at £18,600, while certain benefit-related cases use adequate maintenance rules. Check which assessment applies before preparing evidence.
Which documents will I need?
Your checklist may include passports, status records, relationship and address evidence, financial documents and English evidence. The exact documents depend on your circumstances and application route.
Which English test is required?
A2 speaking and listening is normally required when extending after an initial A1-based grant. You may be able to reuse a qualifying higher-level result or rely on an accepted alternative or exemption.
When should I apply?
Apply before your current permission expires. Plan the submission date around your visa expiry, evidence and settlement eligibility rather than assuming every applicant must apply on the same timetable.
Can I settle after five years?
You may qualify for indefinite leave to remain after five qualifying years on the five-year partner route. Settlement is not automatic: your residence, relationship and other applicable requirements must be checked.

Why Choose Us for Your Spouse Visa Extension
Your extension should be prepared around your circumstances, not a generic checklist. Our solicitors can help identify the rules that apply to you, review your financial evidence and organise the documents needed to explain your case.
That means looking beyond whether a form is complete. We consider changes in employment, gaps in shared-address evidence and previous immigration decisions, then explain what needs attention before submission.
You will know the proposed work and legal fees before instructing us. Start with a free assessment to find out whether our team can help with your spouse visa extension.
How We Prepare Your Extension Application
Once you instruct us, we organise the work around your visa expiry and the issues your application needs to address. Your agreed service sets out the checks, preparation and submission support included.
Step 1
Eligibility and Timing Review
We review your current permission, application history and planned submission date. Your relationship, finances and circumstances help us identify the relevant spouse visa extension requirements and any issues needing individual advice. You know what must be addressed before the application is prepared.
Step 2
Financial and Document Checks
We check the financial category you intend to rely on and the documents needed to support it. This includes reviewing income records, savings evidence, shared-address documents and English evidence where relevant. We flag gaps or inconsistencies so you can deal with them before submission.
Step 3
Application Preparation and Submission
We bring your application details and supporting evidence together, checking that they tell a consistent story. Where included in your agreed service, we prepare legal representations and manage submission. We also explain the next procedural steps and any action you need to take.
Spouse Visa Extension After 2.5 Years: Fees and Costs
For an adult applying inside the UK for a standard 30-month spouse visa extension, the current application fee is £1,407 and the Immigration Health Surcharge is £2,587.50. Together, these government charges total £3,994.50, before any additional services or professional fees.
Application Fee and Immigration Health Surcharge
| Cost | Current amount | What to understand |
|---|---|---|
| In-country application fee | £1,407 | The Home Office charge for the application. |
| Adult Immigration Health Surcharge | £2,587.50 | Based on 2 years and 6 months of permission. |
| Combined government charges | £3,994.50 | For one adult where both charges are payable. |
Additional Costs and Solicitor Fees
Your total UK spouse visa extension cost may also include an English test, certified translations and optional appointment or processing services. Eligible applicants may be offered super priority processing for an additional £1,000, subject to availability and the relevant conditions.
Our legal fees are separate from government charges. Before you instruct us, we explain the proposed work, professional fees, any applicable VAT and relevant additional costs. You can then decide whether the service is right for you.
Fee Waivers and Refunds
Some applicants may qualify for a fee waiver because of their financial circumstances. Eligibility is not automatic, and the waiver process must be handled in the correct sequence before the visa application. Seek advice early where paying the charges would prevent you from meeting essential living needs.
Refund rules differ between payments. For example, the Immigration Health Surcharge is refunded when a visa application is refused; this does not mean every other application-related cost is refundable.
UK Spouse Visa Extension Requirements
The right starting point is your existing immigration permission, not simply the fact that you are married. A partner extension normally requires an ongoing qualifying relationship and compliance with the immigration, suitability, accommodation and other requirements applicable to your route.
Who Can Apply to Extend?
This guidance concerns people extending permission under the UK family partner route. Your partner may be British, settled in the UK or hold another qualifying status. A spouse applying as the dependant of someone with a work or study visa needs the requirements for that separate route.
Requirements After 2.5 Years
Do not assume your deadline falls exactly two and a half years after you arrived. Initial partner permission can differ from extension permission, so check the expiry date and conditions recorded in your immigration decision and status.
Your extension is also a fresh assessment. A previous approval does not remove the need to provide appropriate evidence of your present circumstances.
We can review your existing permission, identify the relevant requirements and explain which parts of your application need closer attention.
Financial Requirement for a Spouse Visa Extension
The financial requirement depends on your application history and circumstances. The standard income threshold is not the correct answer for every applicant.
Which Income Threshold Applies?
| Circumstances | Financial assessment |
|---|---|
| Standard minimum-income requirement | Usually £29,000 a year in qualifying income. |
| Eligible transitional case involving the same partner | A qualifying successful partner application made before 11 April 2024 may allow the earlier £18,600 base requirement to apply. |
| Relevant children in a transitional case | Additional amounts may apply: £3,800 for the first relevant child and £2,400 for each additional relevant child, subject to the applicable £29,000 cap. |
| Sponsor receiving certain specified benefits | The adequate-maintenance assessment may apply instead of the standard minimum-income threshold. |
The transitional rules and child calculations depend on eligibility. We can check which assessment applies before you spend time assembling the wrong financial evidence.
Employment and Self-Employment Income
For an in-country extension, qualifying income from the applicant, the sponsor or both may be relevant, subject to the applicable rules.
Employment evidence commonly includes payslips, matching bank statements and an employer’s letter. A recent job change can alter the calculation and evidence period; a salary figure alone may not establish eligibility.
Self-employment and certain company-director cases use different requirements, often involving a completed financial year, tax records, accounts and business evidence rather than a standard six-month employment bundle.
Using Cash Savings
Qualifying savings can sometimes meet the requirement alone or make up an eligible income shortfall. For extension applications, the calculation generally uses £16,000 plus 2.5 times the relevant annual shortfall.
Where savings alone are used, this produces:
| Applicable annual requirement | Savings-only illustration |
|---|---|
| £29,000 | £88,500 |
| £18,600, with no additional child requirement | £62,500 |
For example, an eligible £4,000 annual income shortfall would require £26,000 in qualifying savings under that calculation.
Savings usually need to satisfy holding-period, ownership, accessibility and source requirements. Exceptions and restrictions apply, and savings cannot be combined with every income category. A bank balance alone does not establish that the requirement is met.
Benefits and Adequate Maintenance
Where specified benefits make the adequate-maintenance rules relevant, the assessment considers available income and housing costs rather than simply applying the standard salary threshold. Suitable accommodation must also be demonstrated.
Tell us about employment changes, self-employment, savings or benefits at the start of your enquiry. That helps us identify the financial questions your application needs to resolve.
Documents Needed for a UK Spouse Visa Extension
A useful document checklist should reflect your application, not somebody else’s circumstances. Start with the purpose of each document: what does it establish, and does it agree with the information in your form?
Your Extension Document Checklist
| Evidence area | Documents that may be relevant |
|---|---|
| Identity and immigration history | Passports, current status details, previous decisions and relevant travel or immigration information. |
| Relationship and family circumstances | Marriage or civil partnership evidence, shared-address records and documents relating to relevant children. |
| Financial position | Evidence required for the income, savings or adequate-maintenance category being relied upon. |
| Accommodation | Evidence showing the property, your right to occupy it and the relevant household arrangements. |
| English language | A qualifying test result, accepted qualification or evidence supporting an exemption. |
| Documents in other languages | Appropriate certified translations where required. |
The application may also require explanations of previous decisions, changes in circumstances or information that appears inconsistent.
Check Dates and Consistency Before Submission
Financial evidence has category-specific requirements. Where the rules require recent evidence, relevant documents must normally fall within the prescribed period, including the applicable 28-day rule. Do not assume older records remain suitable because they were accepted previously.
We can help identify missing evidence and explain what needs clarifying before your spouse visa extension application is submitted.
Accommodation and Evidence of Living Together
Your application should explain both your continuing life together and the accommodation available to you. These are related questions, but they are not interchangeable.
Showing Your Shared Address
Shared-address evidence should help demonstrate the history of your relationship, not merely show that you receive post at the same property today. Depending on your circumstances, relevant records may include tenancy documents, official correspondence or other reliable address evidence.
Periods apart do not necessarily determine the outcome by themselves. Where relevant, explain the reasons and provide evidence consistent with a continuing relationship and intention to live together permanently.
Showing Suitable Accommodation
You do not necessarily need to own a property. Rented accommodation or a suitable arrangement with relatives may be acceptable, provided the relevant occupation, space and other accommodation requirements are met.
The evidence should establish permission to live there and explain who occupies the property. A property inspection report is not automatically required in every case.
English Tests for a Spouse Visa Extension
The English evidence you need depends on your route, previous application and any applicable exemption. Check that position before paying for a new test.
A2 English Test Requirements
For a relevant extension following an initial A1-based grant on the five-year partner route, the usual requirement is A2 speaking and listening. However, some applicants can rely on qualifying evidence already provided or an accepted alternative.
Can You Use a B1 Test or an Earlier Result?
A qualifying B1 result can meet a lower A2-level requirement, but the test and evidence must satisfy the applicable rules. An earlier result may be reusable in permitted circumstances, including some cases where its ordinary validity period has expired.
Do not assume that any English course certificate or any test labelled “B1” will be accepted.
Exemptions and Other English Evidence
Accepted qualifications, qualifying nationality provisions and exemptions can affect what you must provide. Relevant age, disability and exceptional-circumstances provisions need to be checked against the rules.
The 10-year partner route has different English requirements for extension applications; settlement is a separate assessment.
Booking an Approved English Test
Before you book an A2 English test for a spouse visa extension, confirm the required level and check the approved test, provider and location. Use the official approved-provider information and make sure the booking details match your identification documents.
Spouse Visa Extension Processing Times
Processing time depends on the application route and circumstances, not simply on whether you are extending after 2.5 years.
Standard Processing
Official guidance gives an eight-week processing time for relevant in-country partner or spouse applications meeting the financial and English requirements. Cases considered without those standard requirements are not covered by the same timetable; current guidance indicates approximately 12 months for the relevant partner or private-life cases, without a published service standard.
The processing period generally starts after the required identity and evidence steps, rather than necessarily on the date you begin the online form.
Faster Decisions Where Available
Eligible applicants using the relevant appointment process may be offered super priority processing. The current eligibility table does not list the five-working-day priority service for these family visa applications.
Super priority costs an additional £1,000. A decision is usually expected by the next working day after a weekday appointment, with different timing for weekend or bank-holiday appointments. Availability and further checks can affect the outcome and timetable.
What Can Delay a Decision?
Missing information, further checks or a request for additional evidence can affect processing. We can help prepare and organise your application, but the Home Office controls the decision and no solicitor can guarantee a particular completion date.
Spouse Visa Extensions and Settlement
An extension gives further permission to stay. Indefinite leave to remain, often called ILR or settlement, is a separate application with its own requirements.
Extensions on the Five-Year Partner Route
Eligible applicants may apply for settlement after completing five qualifying years on the five-year partner route. The relevant residence period and other requirements must be checked; time spent under a different immigration category does not automatically count.
Spouse Visa Extension After Five Years or ILR?
Reaching five years does not automatically mean you should submit another extension or that you qualify for settlement. Check your route, qualifying residence, current expiry date and the applicable settlement requirements.
Where you are not yet eligible for ILR, further permission may be needed to maintain your position.
Extensions on the 10-Year Partner Route
The 10-year route involves successive periods of permission rather than a single 10-year visa. Its requirements differ from the standard five-year route, and it is not an automatic alternative whenever an applicant cannot meet a particular requirement.
An extension as a partner on the 10-year route normally uses the relevant FLR(FP) process. Check your existing decision and route before choosing an application.
We can help you understand whether your next step is an extension, a settlement application or advice on a different route.
When to Apply for a Spouse Visa Extension
Prepare early enough to identify missing documents, but choose the submission date carefully. Your current permission, evidence and settlement plans all matter.
How Early Can You Apply?
You can apply to extend before your existing permission expires. When extending with the same family member, up to 28 days of remaining permission can be added to the new grant.
Applying More Than 28 Days Before Expiry
Home Office caseworker guidance advises applying no more than 28 days before the relevant expiry date or completion of 30 months on the partner route. An earlier application can be possible, but its timing may leave you needing additional permission before you qualify for settlement.
The practical question is therefore not only “Can I apply early?” but “Which date fits my current permission and next application?”
Preparing Before the Deadline
Start by checking your immigration decision and expiry date, identifying the financial category you will rely on and reviewing any English evidence. Leave time to obtain documents and resolve inconsistencies.
Where your expiry date is approaching, tell us immediately so we can assess whether we can assist within the available time.
How to Apply for a Spouse Visa Extension
A well-prepared application should use the correct route, contain consistent information and include the evidence required for your circumstances.
Choose the Correct Application Route
The online FLR(M) process is used for relevant partner and dependent-child applications, including the standard five-year partner route. Partner applications on the 10-year route use the relevant FLR(FP) process instead. Do not choose a form solely because its title appears similar to your previous application.
Complete the Application and Submit Evidence
Check your answers against your immigration history and documents before submission. Follow the applicable payment, evidence-upload and identity instructions, and keep copies of the submitted information and confirmations.
Understand What Happens Next
You may need to complete an identity appointment or another identity-verification process and respond to further requests. Following approval, check your immigration decision and eVisa details, including the permission dates and conditions.
Our agreed service can bring the application and supporting evidence together, with explanations where your circumstances need more than a standard form response.
While Your Extension Application Is Pending
Where a valid application is made before existing permission expires and remains undecided at expiry, section 3C can extend the applicant’s existing permission and conditions. This can allow existing work rights to continue.
Late or invalid applications may not benefit from that protection. The position needs checking where validity, timing or previous decisions are in question.
Travel While Awaiting a Decision
Leaving the Common Travel Area while an in-country application is pending normally causes the application to be treated as withdrawn. Separately, leaving the UK can end section 3C leave, even where the journey remains within the Common Travel Area.
Take advice before arranging travel during a pending extension application.
Requests for Further Information
Read any Home Office request carefully and respond within the stated deadline. Where we are instructed to handle correspondence, send us any communication you receive so that the required response can be considered.
Changed Circumstances and Application Problems
Changes to Income or Missing Evidence
A new job, reduced earnings, self-employment or missing records may change how your application needs to be prepared. Explain the change at the outset rather than assuming you should submit the same documents as last time.
We can assess the relevant category, identify the gaps and explain the work needed before submission.
Applications Involving Children
Children may need their own extension applications and must meet the relevant requirements. Do not assume their permission is automatically renewed through an adult’s application or that one adult’s fee calculation covers the whole family.
Separation or Relationship Breakdown
Where your permission is based on a relationship that has permanently ended, the usual extension approach may no longer be appropriate. You will normally need to notify the Home Office and consider whether another immigration route is available.
Seek advice promptly rather than submitting an application that does not reflect your circumstances.
An Expired Visa or Previous Refusal
An expired visa, previous refusal or other immigration problem requires an individual assessment. Do not assume the standard extension process will resolve it.
A refusal may carry an appeal right, including in relevant human-rights cases, but the available remedy depends on the decision. The refusal notice and deadline should be reviewed before choosing the next step.

Spouse Visa Extension UK FAQs
No. The application fee and Immigration Health Surcharge are separate charges. Your total may also include English tests, translations, optional services and legal fees. Any applicable exemption or fee waiver must be assessed separately.
An earlier application can be possible, but it may affect how your permission aligns with settlement eligibility. Only up to 28 days of remaining permission can be carried forward when extending with the same family member. Check the timing for your case.
A qualifying B1 result can meet an A2-level requirement. However, the test, provider and evidence must satisfy the rules. Whether a previous result can be reused depends on the circumstances, including how it was accepted in an earlier application.
Not necessarily. Check your previous English evidence and any applicable exemption before booking. Where a new test is needed, choose the correct approved test and provider using the official guidance, then book with matching identification details.
You may be eligible for indefinite leave to remain instead, but five years in the UK does not automatically establish eligibility. Check your qualifying route, residence and other settlement requirements. Further permission may be needed where you do not yet qualify.
The route normally involves successive grants of permission, not one 10-year visa. Its requirements and application process differ from the five-year partner route. The relevant partner extension normally uses FLR(FP), so check your existing decision before applying.
A change can affect the financial category, calculation and evidence period. Do not assume your latest salary alone settles the question. Review the new circumstances, the permitted income sources and the documents required before submitting your application.
