Overview of UK Spouse Visa 10 Year Route

You can apply for a spouse visa with either a 5- or 10-year settlement path in the UK. If a spouse does not fulfil the stricter criteria for the 5-year spouse visa route, they may still apply for the UK spouse visa 10 year route.

For instance, if you do not possess the necessary income, English proficiency, or appropriate housing, you might not be eligible for the 5-year route to settlement in the UK as a holder of a spouse visa. The UK Spouse Visa 10 year route option might be worth considering in this situation.

After 10 years on a spouse visa, you can apply for Indefinite Leave to Remain (ILR). Meanwhile, you have the flexibility to convert to the 5-year spouse visa route whenever you meet the requirements listed in Appendix FM.

If you want to avoid problems, you should hire an immigration lawyer to handle the process for you. Call us now at 02033844389.

What are the UK Spouse Visa 10 Year Route Requirements?

The following are the primary criteria for a UK Spouse visa application under the 10-year route:

  • For both of you, the age must be 18 or older
  • You have to show the genuineness of your relationship
  • You plan to stay together permanently in the UK
  • Also, you have to meet the requirements for adequate housing
  • The person applying must meet the requirements written out in Appendix FM of the Immigration Rules

Depending on your situation, you may also be required to fulfil any further requirements. If you have any questions about applying for a UK Spouse visa 10 year route, our qualified immigration lawyers are here to help.

UK Spouse Visa 10-year Route Financial Requirements

An annual income of £29,000 (or £18,600 if the UK spousal visa application was made before 11 April 2024) is often required of spousal visa ILR applicants on the 5-year path. Even if your salary is too low, you might be able to get a spouse visa through the 10-year route.

Accommodation Requirement

Applicants must fulfil the spouse visa accommodation requirement in order to take the conventional 5-year route to ILR for spouse visa holders. As a result, the lodging must have enough room and follow all health rules.

English Language & Relationship Requirement

The English language requirement for the spouse visa is not applicable if you are applying through the UK spouse visa 10 year route. Unless you are from a qualifying English-speaking country or have a degree or higher that was taught in English, you are typically required to pass an approved English language test to CEFR level A1 under the spouse visa 5-year route. In addition, applicants on the 5-year path may not be required to take the English language test if they are 65 or older or have a long-term physical or mental disability that prevents them from doing so.

Like the 5-year route, the 10-year ILR spouse visa requires that you and your UK-based partner be in a real and continuous relationship. If you are married, in a civil union, or single, you must give proof that you are at least 18 years old. You need to have lived together for at least two years if you’re not married.

UK Spouse Visa Extension 10 Year Route

Renewing your spouse visa through the 10-year path to ILR requires that you remain in a genuine relationship with your partner residing in the UK and that you are living with them. You won’t have to worry about meeting the English language requirement or the spouse visa’s financial requirements, unlike the 5-year path. If your application for a spouse visa extension through the 10-year option is successful, you will be granted an additional 2.5 years of leave.

Our experienced UK immigration Solicitors can help you with your immigration process.

Can I Switch from a 10-year Spouse Visa Route to 5-Years?

Yes. At any point, you have the option to change the spouse visa from the 10-year to the 5-year route. You are able to make this change if you can provide evidence that you now fulfil all the conditions for the spouse visa 5-year route. This necessitates that you now satisfy the housing, English proficiency, and minimum income standards. It’s important to know that if you move to the 5-year spouse visa route, the time you spent on the 10-year route won’t count towards your ILR.

Spouse Visa 10-Year Route ILR

For the spouse visa 10-year ILR route, you can mix time spent in the UK on different visas, but not for the 5-year path. In order to qualify for indefinite leave to remain in the UK, you need to have lived there continuously for a minimum of 10 years on any combination of visas. Keep in mind that being a fiancé, fiancée, or prospective civil partner does not qualify you for time spent in the UK. For instance, in order to qualify for ILR, you might consider time spent on a spouse visa alongside a work or business visa.

After ten years on a spouse visa, you can apply for ILR, but you’ll also have to show that you can speak English at a CEFR level B1. No matter if you’re applying for the 5- or 10-year spouse settlement path, you’ll still need to show proof that you passed the Knowledge of Life in the UK test.
